If the property is properly zoned, a residence can be built in any one of these districts. To clarify there are some lots less than 35 acres that are zoned AG/Forestry that are buildable. These lots were created before that particular Township adopted County Zoning. These lots are considered “legal non-conforming,” meaning they were legally created but they don’t meet the requirements of AG/Forestry minimum lot size. The term legal non-conforming is also referred to as being “grandfathered in”.

 

Richland County Zoning Ordinance does not have a limit on the size of lots that can be sold. Richland County Zoning does, though, talk about minimum lot sizes and zoning districts they fall under to be a buildable lot. The minimum lot size for AG/Forestry Zoning District is 35 cares. If you sell off some land that is going to create a parcel less than 35 cares, then it would need to be rezoned to make it a buildable lot. Akan Township has a land use plan that states that we want to have a “density” of one house per 35 acres or would prefer to have a minimum lot size of 35 acres.
